By downloading, installing, or using OpenwayVPN, you agree to be bound by these Terms of Service. Please read them carefully before using the application.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and OpenwayVPN ("we", "our", "us"). If you do not agree to these terms, do not download or use our application. By using the service, you confirm that you are at least 17 years of age (as required by the Apple App Store).

2. Description of Service

OpenwayVPN provides a virtual private network (VPN) service for iOS that encrypts your internet connection and routes it through our servers, helping protect your privacy and security online. The service is available exclusively via our iOS application distributed through the Apple App Store.

3. Free Service

OpenwayVPN is currently available free of charge. No subscription, payment, or credit card is required to use the application. All features are available to all users at no cost.

We reserve the right to introduce paid plans or premium features in the future. Any such changes will be communicated to users in advance via in-app notification or email, and will not affect your continued access to the free tier as it exists at the time of notification.

4. Acceptable Use

You agree NOT to use OpenwayVPN to:

• Engage in any illegal activities under applicable law
• Distribute malware, spam, or other harmful content
• Violate the intellectual property or privacy rights of others
• Attempt to gain unauthorized access to computer systems or networks
• Harass, threaten, or harm other individuals
• Conduct denial-of-service (DoS) attacks or port scanning
• Violate any applicable local, national, or international laws or regulations

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

5. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must notify us immediately at [email protected] if you suspect unauthorized access to your account. OpenwayVPN is not liable for losses resulting from unauthorized use of your account.

6. Payments and Refunds

OpenwayVPN is currently free of charge. There are no payments, purchases, or in-app transactions. Should paid features be introduced in the future, refund terms will be governed by Apple's App Store refund policy and will be communicated at that time.

7. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We are not liable for damages resulting from service interruptions, outages, or delays beyond our reasonable control.

8. Privacy

Your use of OpenwayVPN is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

All content, design, software, and materials in the OpenwayVPN application are owned by or licensed to us and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

10. Disclaimer of Warranties

OpenwayVPN is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the service will be error-free, secure, or uninterrupted. VPN services cannot guarantee complete anonymity.

11. Limitation of Liability

To the maximum extent permitted by applicable law, OpenwayVPN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of or inability to use our service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via in-app notification or email. Continued use of the service after the effective date of changes constitutes your acceptance of the new Terms.

13. Termination

We may suspend or terminate your access to OpenwayVPN at our discretion, including for violation of these Terms, without prior notice or liability. Upon termination, your right to use the service ceases immediately. You may cancel your account at any time through Apple App Store subscription settings.

14. Apple App Store Terms

Your use of the iOS application is also subject to Apple's App Store Terms and Conditions. In the event of a conflict between these Terms and Apple's terms, Apple's terms shall govern with respect to the App Store relationship.

15. Governing Law

These Terms are governed by applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration, except where prohibited by law. Nothing in these Terms affects your statutory consumer rights.
